The Foresight Privacy Statement (“this Privacy Statement”) outlines our ongoing obligations to you with respect to how we manage your Personal information.
Foresight has adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (“the Privacy Act”). The APPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information. When does this Privacy Statement apply? This Privacy Statement applies where you access our website, which is the website under the domain name “foresight.net.au”. Your use of our website indicates that you accept the Privacy Statement, and consent to the collection and use by us of your Personal Information according to the terms below.
Foresight may amend this Privacy Statement from time to time, and users are advised that continued use of our sites following amendment is deemed confirmation of acceptance.
Collection of information:
Personal Information is information or an opinion that identifies an individual. Personal Information collected by Foresight is directly provided by you through the use of our webforms. Examples of Personal Information we collect includes, but is not limited to: names, addresses, email addresses, and phone numbers. Where reasonable and practicable to do so, Foresight will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case, Foresight will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.
Non-personal Information includes information that cannot be used to personally identify you. Non-personal Information may be collected passively by Foresight through your use of our website. This includes but is not limited to anonymous usage data, general demographic information, referring/exit page URLs, platform types, operating system, and browser type.
The Foresight website uses Google Analytics to track user behaviour. This may include the use of session and persistent cookies and navigational data (such as URLs) to gather information regarding the date and time of your visit and the information and services which you viewed. Sensitive Information as defined in the Privacy Act is not expected to be collected by the Foresight website. Foresight will endeavour to discard any sensitive information you provide on the website within a reasonable time. Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.
Use and disclosure of Personal Information:
We collect your Personal Information for the primary purpose of providing our services to you and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure (for example if you engage with us as a service provider). As you would reasonably expect, the nature of the Personal Information held by us will vary depending on the nature of the interaction between you and Foresight (for example where a recruitment candidate provides their Personal Information on our recruitment webform, their contact details may be stored to contact them throughout the recruitment process). Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure. Subject to the exceptions listed in the Privacy Act, Personal Information will be stored securely and only be accessed by authorised Foresight staff, or professional advisers if required, all of whom are bound by the Privacy Act and this Privacy Statement. Your Personal Information may be disclosed to third parties only where you consent to the use or disclosure, or where Foresight is required or authorised to do so by law. When your Personal Information is no longer needed for the purpose for which it was obtained, Foresight will take reasonable steps to destroy or permanently de-identify your Personal Information. Depending on the nature of your engagement with Foresight, we may store Personal Information with your consent in client files which will be kept by us in accordance with the Archives Act 1983 (Cth).
Access and correction of Personal Information It is your responsibility to ensure that the Personal Information you provide us is accurate and up to date. If you have reason to believe the information we have is not up to date or inaccurate, please advise us as soon as practicable so we can update our records and continue to provide quality services to you. You may access the Personal Information we hold about you and to advise of any perceived inaccuracies or incompleteness. The Privacy Act outlines some exceptions where Foresight may not be obliged to update that information, for example where it is unreasonable and/or prevented by law to do so. To make a request to access or update any Personal Information Foresight holds about you, please contact us in writing using the contact details provided below. In order to protect your Personal Information, we may require identification from you before releasing the requested information.
Mandatory data breach notification Foresight is committed to protecting your data and Personal Information. However as the internet is an inherently unsecure environment, if a data breach were to occur, Foresight will endeavour to identify and mitigate the risk of harm and implications to individuals whose information may be affected. Where there is unauthorised access to, or unauthorised disclosure and/or loss of, personal information held by Foresight that cannot be effectively mitigated, we will further endeavour to notify the relevant parties as soon as practicable where required by the law.
